Joint operation and seller

This website is jointly operated by Cherrycom Worldwide SL and Zhangjiagang Seawing Import & Export Trade Co., Ltd.

For each transaction, the seller or merchant named in the order confirmation, invoice and payment instructions is the contract seller. A product page, enquiry, sample request or displayed price does not itself create a binding sales contract.

Product information and samples

Product pages support product discovery and enquiry preparation. They are not a binding quotation, purchase order, stock commitment or guarantee of an order-specific specification. Configuration, packaging, quantity, price, payment, shipping, timing, testing and delivery are confirmed in written order documents.

The sample-order page records a request and delivery details. Its displayed sample price covers the product only and no payment is collected on that page. Shipping and payment instructions are confirmed before payment. A sample credit against a bulk order applies only if the final written bulk order expressly states it.

Eligibility and lawful online use

By using this website, you confirm that you have legal capacity to agree to these Terms or authority to act for the business you represent. Minors may not submit an enquiry, sample request or order without the involvement and consent required by law.

You may not use the website or its services for an illegal or unauthorized purpose, transmit malicious code, or interfere with its operation or security. A material breach may result in suspension or termination of access.

General conditions

We may refuse or restrict access or a request where reasonably necessary for legal, security, fraud-prevention, sanctions, availability or operational reasons. Nothing on the website obliges a contract seller to accept an enquiry or order.

Except for information governed by our Privacy Policy or handled by a payment provider, internet transmissions may pass through different networks. You may not reproduce, resell or commercially exploit the website or its content without written permission.

Accuracy, completeness and timeliness

Website material is general product and business information and may be incomplete, superseded or corrected. Buyers should rely on the current written quotation, specification, sample approval, invoice and order confirmation when making an order decision. Historical material is provided only for reference.

Service, availability and price changes

We may modify, suspend or discontinue website content, features or products. Displayed sample prices, descriptions and availability may change before an order is accepted. Order-specific price, currency, quantity, freight, taxes, duties, payment fees and delivery terms are confirmed in writing.

Products, samples and order acceptance

Images, colours, dimensions and descriptions are presented as accurately as reasonably possible, but screens, photography, product revisions and configurations may differ. Confirm the exact SKU, variant, specification, artwork, packaging and approved sample in the written order documents.

A submitted enquiry or sample request is not automatic acceptance. We may limit or decline a request, correct a displayed error, or cancel an unaccepted request. Returns and remedies follow the Returns & Refunds Policy and the applicable written order.

Billing, delivery and account information

You must provide current, complete and accurate contact, billing, delivery, customs and order information and promptly notify us of changes. We may verify or decline duplicate, inconsistent, fraudulent, sanctioned or otherwise high-risk requests.

Third-party services and tools

The website may use hosting, analytics, communications, payment, mapping, logistics or other third-party services governed by their own terms and privacy notices. Review the provider's terms before using an optional tool. New website features remain subject to these Terms.

Comments, feedback and submissions

If you send feedback, specifications, artwork, photographs, ideas or other materials, you confirm that you have the right to submit them and that they are accurate, lawful and do not infringe another person's rights.

We may use submitted materials as reasonably necessary to answer the enquiry, assess feasibility, prepare a quotation, provide the requested service or improve the website. Identify confidential materials and use a separate written confidentiality agreement where needed.

Personal information

Personal information is handled under our Privacy Policy. Payment details, when payment is available, are handled through the applicable payment channel. Do not send passwords, full card details or unnecessary sensitive information through an enquiry form or ordinary email.

Errors, inaccuracies and omissions

The website may contain typographical errors, outdated fields or omissions concerning descriptions, prices, freight, transit times or availability. We may correct such information and update or cancel an unaccepted request affected by a material error. A page date does not mean every part of the website was updated on that date.

We may block access and preserve or disclose relevant records where law permits.

We do not promise that the website will always be uninterrupted, error-free or suitable for every purpose. Website information is provided as available; product and transaction obligations arise from the applicable written order and mandatory law.

To the maximum extent permitted by law, the website operators and service providers are not liable for indirect or consequential loss arising only from use of, or inability to use, the website. Nothing excludes liability or statutory rights that cannot legally be excluded or limited.

Intellectual property

The website, Seawing brand elements, page design, text, graphics and original media are owned by or licensed to the relevant rights holder and protected by applicable intellectual-property law. Product references supplied by third parties remain subject to their rights. No licence is granted except the limited right to view and use the site for a legitimate enquiry or order.

Suspension, termination and indemnity

We may suspend or terminate website access for a material breach, unlawful activity, security risk or required legal action. Accrued payment, confidentiality, intellectual-property, liability and other provisions intended to survive remain effective. To the extent permitted by law, a user is responsible for loss and third-party claims caused by that user's unlawful use, infringement or breach of these Terms.

Severability, waiver, entire agreement and assignment

If a provision is unlawful or unenforceable, it is limited or severed only to the extent necessary and the rest remains effective. A delay in enforcing a right is not a waiver. These Terms, linked policies and applicable written order documents form the agreement for the relevant website use and transaction. You may not transfer an accepted order or these obligations without written consent; an operator or contract seller may transfer rights as law permits without reducing mandatory consumer rights.

Changes and contact

We may update these Terms by publishing a revised version and date. Changes apply prospectively unless law or the accepted written order requires otherwise. Questions, notices or complaints may be sent to gemini@seawingglobaltrade.com with enough information to identify the matter.

Changes and governing law

Changes or cancellations must be requested by email and take effect only after written confirmation by the contract seller. They may not be possible after production, customization, packing, shipment or carrier handover begins.

These Terms of Service and any separate agreements whereby we provide services shall be governed by and construed in accordance with the law of Spain.
